Customer Agreement

These Terms of Service are part of every online booking, service plan, quote, estimate, invoice, work order, and service visit provided by Just Clean Gutters LLC, doing business as Just Clean Windows & Gutters (“Company,” “we,” “us,” or “our”) to the customer, property owner, tenant, manager, or authorized representative (“Customer,” “you,” or “your”).

By scheduling service, signing up for a service plan, approving a quote, clicking accept, signing a work order, allowing us onto the property, or paying an invoice, you agree to these Terms.


1. Services and What Is Included

We provide residential window cleaning and gutter cleaning, booked as one-time services or through an annual service plan under Section 10. What each visit includes depends on the services and add-ons selected at booking or included in your plan.

Gutter cleaning

A standard gutter cleaning includes:

(a) removing leaves, sticks, sediment, and other debris and buildup from the gutters, including debris in roof valleys and other water-flow areas that is reasonably accessible from the ground with our vacuum equipment;

(b) cleaning up material that falls to the ground during service;

(c) checking that water flows from the visible downspout openings;

(d) bagging removed debris and leaving it with your waste receptacle; and

(e) making service photos available through the customer portal.

Downspout flush (add-on). Flushes all downspouts on the property. Clearing a stubborn clog may require disassembling a portion of a downspout, and you authorize us to do so when the technician believes it is reasonably needed.

Gutter Exterior Wash (add-on). Washes the exterior face of the gutters to remove streaks and grime. It is not pressure washing, and significant discoloration may require a house cleaner or painter.

We clean gutters that have gutter guards installed at the same flat rate. Removing or reinstalling gutter guards is not included.

Window cleaning

A standard window cleaning includes:

(a) washing exterior glass to a clear, streak-free finish;

(b) wiping down window frames, sills, and tracks;

(c) knocking loose dust and debris off window screens; and

(d) cleaning up after ourselves.

Window add-ons. Interior glass cleaning, dedicated track cleaning, and full screen cleaning are available when selected at booking or included in your plan. Interior cleaning requires someone at the home to provide access inside.

Hard mineral deposits that have etched into the glass may not fully come out with cleaning. We clean the accessible exterior windows on most homes; very high windows and hard-to-reach custom glass may have limitations. Homes with more than 40 windows or custom glass features are quoted individually, so please contact us before booking.

What is not included

Unless specifically stated in writing, our services do not include:

(a) repair, sealing, realignment, replacement, or reattachment of gutters, downspouts, windows, glass, or screens;

(b) roof repair, fascia repair, soffit repair, siding repair, painting, caulking, or carpentry;

(c) underground drain clearing, buried drain inspection, French drain work, or sewer or drain plumbing;

(d) pressure washing, roof cleaning, exterior house washing, or stain removal, other than the Gutter Exterior Wash when selected;

(e) installation, removal, repair, or reinstallation of gutter guards, gutter screens, filters, or covers;

(f) window tinting, film application or removal, or glass replacement;

(g) servicing rain barrels;

(h) tree trimming;

(i) pest removal, mold remediation, hazardous material handling, or removal of animal waste; or

(j) correction of design defects, improper slope, undersized gutters, roof defects, or water-intrusion conditions.

We may decline, pause, reschedule, or modify service if we determine that access, weather, roof condition, roof-mounted equipment, insects, animals, electrical hazards, or other conditions make the work unsafe or impractical.


2. Pricing, Booking, and Payment

Our prices are flat rate and are shown before you book. Your price is set by the home size and services you select at booking:

(a) gutter cleaning is priced by the home’s square footage and whether the property has a detached structure with its own gutter system;

(b) window cleaning is priced by home size, and each home size corresponds to a window range; and

(c) add-ons are priced as shown at booking.

Townhomes, duplexes, condos, and attached homes are priced by square footage, the same as single-family homes. Homes over 4,500 square feet and homes with more than 40 windows or custom glass features are quoted individually.

The amount of debris, gutter length, gutter guards, how dirty your glass is, and typical property conditions do not change the flat rate. We will not perform work that changes your price without your approval.

Wrong service level. If the wrong selection was made at booking, you can change your appointment using the confirmation link in your booking email. If a technician finds that the selected service level does not match the property, they will try to contact you for approval to perform the correct level of service at its posted price. If you are unavailable or decline, we may treat the appointment as a cancellation under Section 3.

Payment. One-time services are paid online at the time of booking through our third-party payment processor. Service plans are billed as described in Section 10. Amounts not paid when due may be subject to collection costs and reasonable attorney’s fees to the extent allowed by law.


3. Scheduling, Weather, Cancellations, and Refunds

You choose a service day when you book. A technician will contact you through your preferred contact method, generally 1 to 2 business days before the appointment, to confirm a service window. If the proposed window does not work, the technician will do their best to adjust it. Service windows are estimates and may be affected by weather, traffic, staffing, prior jobs, safety concerns, or property conditions.

We may reschedule service due to rain, lightning, high winds, wet roofs, extreme heat, unsafe ladder conditions, insects, animals, or other hazards. If that happens, we will help you choose the next appropriate service day.

Your cancellations and rescheduling. Rescheduling and cancellations are free when completed more than 48 hours before the appointment. Cancellations made less than 48 hours before the appointment receive a 50% refund.

Access problems. If a technician arrives and cannot perform the service because of a locked gate, pets, blocked access, occupants who were not notified, or another access issue, the technician will make reasonable attempts to contact you. If the issue cannot be resolved, we may treat the appointment as a cancellation and issue a 50% refund. The same applies when you are unavailable for, or decline, the correct service level under Section 2.

Areas we cannot reach. If a covered patio, pergola, screened porch, or other structure blocks part of the gutter system, or a window cannot be safely reached, the technician will notify you and try to reach the area from adjoining access when safe and feasible. If an area still cannot be serviced, you may request a partial refund based on the share of the gutter system or windows that could not be serviced.

Processing fee. Refunds are subject to a $15 processing fee, except partial refunds for areas we cannot reach, which carry no fee.

Service plan cancellations are governed by Section 10.


4. Customer Authority and Property Access

You represent that you own the property or are authorized by the owner to order the services. If you book service for a property you do not live in, such as a rental property or a family member’s home, you are responsible for notifying the occupants.

You authorize us and our employees, contractors, and representatives to enter the property at the scheduled time and to use reasonable access methods needed to perform the service, including ground-based vacuum and camera equipment, ladders, adjoining roof access when safe, driveways, walkways, gates, exterior water spigots, and exterior electrical outlets when reasonably necessary.

You do not need to be home for exterior-only service as long as we have complete access. If you selected interior window cleaning, someone must be home to provide access inside.

You are responsible for ensuring that:

(a) gates are unlocked;

(b) pets are secured indoors or away from work areas;

(c) vehicles are moved out from under gutters and away from windows;

(d) furniture, planters, toys, grills, decorations, and fragile items are moved away from gutters, downspouts, windows, ladder areas, and work zones;

(e) for interior window cleaning, window sills are cleared and breakable items are moved away from the windows;

(f) rain barrels are disconnected before service, unless a technician disconnects them with your supervision;

(g) outdoor cameras, lighting, wiring, irrigation parts, decor, and landscaping that may be fragile are identified before service; and

(h) tenants, occupants, neighbors, homeowners association (HOA) contacts, property managers, and security services are notified as needed.

When necessary, technicians may move furniture or other objects in the work area to help prevent damage. We do not cover plants with tarps or blankets, because covering them can crush them and cause more damage than falling debris.


5. Customer Disclosure of Known Conditions

Before service begins, you must tell us about any known or suspected conditions that may affect safety, access, or risk of damage, including:

(a) loose, sagging, rusted, cracked, or detached gutters;

(b) rotted or soft fascia, soffit, trim, decking, or roof edges;

(c) brittle, cracked, loose, aging, or specialty roofing materials;

(d) roof leaks, prior water intrusion, stained ceilings, or known drainage problems;

(e) loose gutter guards, screens, covers, brackets, hangers, spikes, screws, or fasteners;

(f) cracked, chipped, or scratched glass, failed window seals, fogged insulated glass, window film or tint, or specialty or antique glass;

(g) loose, torn, or brittle window screens, or loose window frames or tracks;

(h) skylights, solar panels, satellite equipment, antenna wires, security wires, low-voltage wiring, or holiday lighting;

(i) beehives, wasp nests, hornet nests, birds, rodents, snakes, or other pests; and

(j) buried drains, fragile landscaping, irrigation heads, invisible fencing, or underground utilities near ladder areas.

We rely on the information you provide. Failure to disclose known hazards or fragile conditions may affect responsibility for any resulting damage or additional cost.


6. Pre-Existing, Hidden, and Fragile Conditions

Our services involve normal contact with gutters, downspouts, roof edges, shingles, siding, fascia, windows, screens, frames, ladders, and surrounding surfaces. Some properties have pre-existing, hidden, weakened, deteriorated, improperly installed, or fragile conditions that may not be visible before work begins.

We are not responsible for damage, movement, cracking, leakage, separation, staining, or failure caused by or resulting from:

(a) pre-existing damage or wear;

(b) hidden or latent defects;

(c) rotted wood, deteriorated fascia, loose trim, brittle shingles, degraded sealant, loose fasteners, poor installation, or age-related failure;

(d) improperly sloped, overloaded, unsupported, rusted, or damaged gutters;

(e) gutter guards or screens that are brittle, bent, loose, improperly installed, or not designed for removal and reinstallation;

(f) glass that is already scratched, cracked, chipped, or etched, failed window seals, or fogged insulated glass;

(g) window screens, frames, tracks, or weatherstripping that are brittle, torn, bent, or deteriorated, or window film or tint that is peeling or damaged;

(h) roof, siding, window, paint, stucco, masonry, or trim surfaces that cannot withstand normal, careful ladder placement or service-related contact;

(i) clogged, blocked, crushed, disconnected, or improperly designed underground drains; or

(j) water intrusion caused by roof defects, flashing defects, gutter design, drainage design, clogged underground drains, prior leaks, or weather conditions.

This section does not excuse damage caused solely by our gross negligence, willful misconduct, or intentional wrongdoing.


7. Water Flow, Drainage, and No Guarantee Against Future Overflow

Gutter cleaning improves debris flow in accessible areas, but it does not guarantee that gutters, downspouts, drains, roofs, or foundations will properly handle all water after service.

We do not guarantee prevention of:

(a) future clogs;

(b) overflowing during heavy rain;

(c) roof leaks;

(d) foundation issues;

(e) basement, ceiling, wall, or interior water intrusion;

(f) drainage backup from underground lines; or

(g) water damage caused by design, slope, installation, capacity, roof, flashing, or grading issues.

If we notice a larger issue, such as a sagging gutter, structural damage, or damaged glass or screens, we will provide photos of what we found so you can decide the next step. We are not responsible for inspecting, diagnosing, or correcting those conditions unless specifically agreed in writing.


8. No Mess Guarantee

We clean up after ourselves. Debris that falls during gutter service is cleaned up, window cleaning leaves no mess on the ground, walls, or floors, and we finish glass for a streak-free, spot-free result.

If something falls short of that, tell us within 48 hours after service and include a photo. We will come back and fix the affected area at no charge.

This guarantee covers our cleanup and cleaning results. It does not cover pre-existing conditions, mineral deposits etched into glass, or spots from rain, sprinklers, or other water after we leave. Property damage claims are handled under Section 12.


9. Photos and Documentation

You authorize us to take photos or videos of the property before, during, and after service for documentation, quality control, billing, safety, training, and claim investigation. Service photos are made available to you through the customer portal.

We will not knowingly use photos that identify your address, people, personal items, security details, or private areas for public marketing without permission, unless the images are anonymized or cropped to remove identifying information.


10. Annual Service Plans

Plans. We offer annual service plans for window cleaning, gutter cleaning, or both, at the visit frequency shown for each plan. Each plan’s included services, included add-ons, and price are shown at signup and are based on home size. Plans are available for homes up to 3,500 square feet; for larger homes or homes with a detached structure, contact us for a quote.

Billing. You can pay the annual total once a year, or, where offered, in equal payments, one for each visit in the year. Your plan starts once your first payment is confirmed. Payments are charged automatically to the payment method you provide, on the schedule shown at signup.

Scheduling. We will contact you to schedule your first visit after your plan starts. For later visits, we will send a recommended date based on your plan’s frequency, and you can reschedule to another date.

12-month term and automatic renewal. Each plan is a 12-month commitment. Your plan renews automatically for another 12 months unless you cancel before the renewal date. We will email you at least 30 days before each renewal with the renewal date, the renewal price, and how to cancel.

Cancelling. You can cancel at any time to stop your plan from renewing. Payments already made are not refunded. If you pay per visit, the remaining payments for the current 12-month term stay due, and you keep the visits included in that term.

How to cancel. Call (512) 900-4171 or email info@justcleanwindows.com. We will confirm your cancellation in writing.

Plan visits are scheduled and performed under these Terms, the same as one-time services.


11. Texas Home-Solicitation Transactions

If you buy our services from a representative in person at your home, rather than booking online, and the transaction is a consumer transaction subject to Chapter 601 of the Texas Business & Commerce Code, you will receive the legally required notice of your right to cancel and a cancellation form. In that case, any conflicting cancellation term in these Terms does not apply. Otherwise, this Section does not create cancellation rights beyond those in these Terms or applicable law.


12. Damage Claims and Opportunity to Inspect

If you believe we caused property damage, you must notify us in writing at info@justcleanwindows.com as soon as reasonably possible.

For damage visible at or shortly after completion, notice should be provided within 48 hours after service. For damage not reasonably discoverable within that time, notice should be provided within 5 days after discovery.

Your notice should include:

(a) the service date;

(b) a description of the claimed damage;

(c) photos or videos;

(d) the location of the damage; and

(e) any relevant repair estimate, invoice, or report.

Except for emergency repairs needed to prevent further damage or protect safety, you agree to give us a reasonable opportunity to inspect the claimed damage before repairs are made. If emergency repairs are necessary, you agree to document the condition with photos and keep receipts.

Failure to provide timely notice or an opportunity to inspect will not automatically waive a valid claim, but it may reduce or bar recovery to the extent our ability to investigate, verify, mitigate, or submit the matter to insurance is materially prejudiced.


13. Important Liability Terms

Please read this section carefully.

TO THE FULLEST EXTENT PERMITTED BY LAW, CUSTOMER AGREES THAT COMPANY IS NOT LIABLE FOR PROPERTY DAMAGE CAUSED BY PRE-EXISTING CONDITIONS, HIDDEN OR LATENT DEFECTS, NORMAL WEAR AND TEAR, CUSTOMER’S FAILURE TO DISCLOSE KNOWN CONDITIONS, UNSAFE OR INACCESSIBLE PROPERTY CONDITIONS, IMPROPER INSTALLATION, AGE-RELATED FAILURE, WEATHER, DRAINAGE DESIGN, ROOF DEFECTS, UNDERGROUND DRAINAGE PROBLEMS, OR CONDITIONS OUTSIDE COMPANY’S CONTROL.

TO THE FULLEST EXTENT PERMITTED BY LAW, FOR DIRECT PHYSICAL DAMAGE TO CUSTOMER’S PROPERTY CAUSED BY COMPANY’S ORDINARY NEGLIGENCE IN PERFORMING THE SERVICES, CUSTOMER’S EXCLUSIVE REMEDY IS LIMITED TO, AT COMPANY’S OPTION: RE-PERFORMANCE OF THE AFFECTED SERVICE, REPAIR OF THE DAMAGED AREA, PAYMENT OF REASONABLE ACTUAL REPAIR COSTS, OR A REFUND OF THE AMOUNT PAID FOR THE SERVICE VISIT. COMPANY’S TOTAL LIABILITY FOR ANY SERVICE VISIT WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT CUSTOMER PAID FOR THAT SERVICE VISIT; OR (B) $1,000.

COMPANY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF USE, LOST RENT, DIMINUTION IN VALUE, EMOTIONAL DISTRESS, BUSINESS INTERRUPTION, OR DAMAGE CAUSED BY DELAYED REPORTING OR FAILURE TO MITIGATE.

NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, INTENTIONAL WRONGDOING, FRAUD, OR NON-WAIVABLE CONSUMER RIGHTS.


14. Customer Indemnity

To the fullest extent permitted by law, Customer agrees to defend, indemnify, and hold harmless Company and its owners, employees, contractors, insurers, and representatives from and against third-party claims, damages, losses, fines, penalties, costs, and expenses, including reasonable attorney’s fees, arising out of or related to:

(a) Customer’s breach of these Terms;

(b) Customer’s failure to disclose known hazards, defects, fragile conditions, or access restrictions;

(c) inaccurate or incomplete information provided by Customer;

(d) unsafe property conditions not caused by Company;

(e) pets, animals, insects, or pests on the property;

(f) claims by tenants, occupants, neighbors, homeowners associations, property managers, or other third parties where Customer lacked authority, failed to provide notice, or failed to secure permission; or

(g) Customer’s instructions that require us to work around known risks or unusual property conditions.

This indemnity does not require Customer to indemnify Company for Company’s gross negligence, willful misconduct, intentional wrongdoing, or any matter for which indemnity is not allowed by law.


15. No Waiver of Non-Waivable Rights

These Terms are intended to allocate business risk in a reasonable manner. They do not waive any rights that cannot legally be waived, including non-waivable rights under applicable consumer protection laws.

If any provision is found invalid or unenforceable, the remaining provisions remain in effect, and the invalid provision will be modified only to the minimum extent necessary to make it enforceable.


16. Insurance

We maintain insurance coverage that we consider appropriate for our business. Insurance coverage does not create liability where liability does not otherwise exist under these Terms or applicable law. Any claim submitted to insurance remains subject to policy terms, exclusions, deductibles, investigation, and coverage determinations.

Upon request, we may provide proof of insurance.


17. Disputes, Governing Law, and Venue

Before filing a claim, the parties agree to attempt in good faith to resolve disputes informally.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any lawsuit or legal proceeding must be filed in the state or county courts located in Williamson County, Texas, unless applicable law requires a different venue.


18. Changes to These Terms

We may update these Terms from time to time. The version you accept when you book applies to that booking. For service plans, the version in effect at each renewal applies to the renewed term, and we will link it in your renewal reminder. The current version number and effective date appear at the top of this page.


19. Entire Agreement

These Terms, together with your booking confirmation, the plan details shown at signup, and any applicable quote, invoice, work order, or written service description, form the entire agreement between Customer and Company for the services. The frequently asked questions (FAQ) on our website summarize these Terms in plain language; if they conflict, these Terms control. Any changes must be in writing and approved by Company.


Customer Acknowledgment

By checking the acknowledgment boxes at booking or plan signup, signing a work order, clicking accept, approving a quote, scheduling service, or allowing Company onto the property, Customer confirms that Customer has read, understood, and agreed to these Terms, including the Important Liability Terms above.

When you book online, you will be asked to confirm the following before your booking is submitted:

  • I have read and agree to the Terms of Service.
  • I understand and agree to the Important Liability Terms, including the limitation of liability for ordinary negligence and the requirement to disclose known property hazards.
  • For service plans: I understand my plan is a 12-month commitment that renews automatically each year unless I cancel before the renewal date, that payments already made are not refunded, and that if I pay per visit, the remaining payments for the current term stay due if I cancel.
